1. Scope and Preamble

These General Terms of Service and Sale (the "Terms") govern the contractual relationship between Alexis DA CRUZ, sole proprietor (SIREN 829 534 262, located at 106 B Avenue Roger Salengro, Bât. B, 69120 Vaulx-en-Velin, France, email: [email protected]) and any individual or legal entity (the "Client") browsing the website alexisamz.com, commissioning freelance services, or purchasing digital content.

Any order or purchase implies full, complete, and unreserved acceptance of these Terms.

2. Freelance Services (Web Development, Photography, Video)

2.1 Quotes and Contract Formation

Each web development, photography, or video production project is subject to a customized written quote, valid for 30 days from issuance. The contract is concluded upon receipt of the signed quote accompanied by the agreed initial deposit (typically 30% to 50% of the total amount).

2.2 Performance and Delivery

Alexis DA CRUZ agrees to perform the services with professional diligence in accordance with industry best practices. Delivery schedules are provided as estimates and depend upon timely receipt of required Client materials (specifications, copy, visual assets, technical credentials).

2.3 Payment Terms and Late Fees

Invoices are payable upon delivery or receipt. Any late payment automatically incurs statutory late penalties at the ECB refinancing rate plus 10 percentage points, alongside a statutory flat recovery fee of 40 euros for commercial entities (Article L. 441-10 of the French Commercial Code).

3. Sale of Digital Products and Premium Access

3.1 Products and Ordering

The website alexisamz.com offers digital content (in-depth technical guides, configuration files, runbooks for coding agents). Orders are placed directly online through secure electronic payment.

3.2 Pricing and Payment Methods

Prices are stated in euros (€) including all applicable taxes. Payment is made in full at the time of purchase by credit/debit card via the secure payment processor Stripe. Alexis DA CRUZ does not store or process card numbers directly.

3.3 Digital Delivery

Upon payment confirmation by Stripe, the Client receives immediate access to unlocked content and a personal access code via email. Access is granted on a lifetime basis for the purchased item.

3.4 Waiver of Right of Withdrawal (Digital Goods)

Under European consumer law and Article L. 221-28 13° of the French Consumer Code, the statutory 14-day right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium once performance has begun with the consumer's prior express consent. By validating purchase via Stripe, the Client expressly consents to immediate fulfillment and acknowledges the forfeiture of their right of withdrawal.

4. Intellectual Property

Freelance Services: Transfer of exploitation rights (reproduction, distribution) over graphic, photographic, audiovisual, or software creations is contingent upon full payment of the agreed project price.

Digital Products: Purchase grants a personal, non-exclusive, and non-transferable license to use the guide or code. Redistribution, public sharing, resale, or unauthorized republication of purchased files or access codes is strictly prohibited.

5. Limitation of Liability and Force Majeure

Alexis DA CRUZ makes reasonable efforts to ensure continuous site availability. Liability cannot be incurred for disruptions caused by Internet network failures, third-party hosting outages (Vercel, Cloudflare, Stripe), or force majeure events recognized by law.

6. Applicable Law and Dispute Resolution

These Terms are governed by French law. In the event of a dispute, the Client is encouraged to first contact [email protected] to reach an amicable resolution.

Consumers retain the right to free recourse to an approved consumer mediator. In the absence of an amicable agreement, exclusive jurisdiction is assigned to the competent courts of Lyon, France.
